ORDINANCE NO. 6624

Relating to Planning and Zoning; Repealing Ordinance No. 3038; Adopting a Recodification in the Tucson Code of Tucson Zoning Code Chapter 23, Article I Zoning; Article II, Administration and Procedures; Article III Subdivisions; Article IV Off-Street Parking; Article V, Off-Street Loading. Authorizing Publication of the Tucson Zoning Code Chapter 23 as a Separate Publication.

Be It Ordained by the Mayor and Council of the City of Tucson, Arizona as Follows:

Section 1. That Ordinance No. 3038 passed and adopted by the Mayor and Council September 11, 1967, is hereby repealed.

Section 2. That Tucson Zoning Code, chapter 23, sections 23-1 through 23-661 is recodified in the Tucson Code as follows: Article I, Zoning; Article II, Administration and Procedures; Article III, Subdivisions; Article IV, Off-Street Parking, Article V, Off-Street Loading.

Section 3. Chapter 23 of the Tucson Code may hereafter be published as a separate official publication entitled the Tucson Zoning Code, in addition to being incorporated into the Tucson Code.

Section 4. Severability. If any provision of the Tucson Zoning Code or the application thereof to any person or circumstance is held invalid, the invalidity shall not affect other provisions or applications of the Tucson Zoning Code which can be given effect without the invalid provision or circumstance, and to this end the provisions of the Tucson Zoning Code are severable.

Section 5. The various city officers and employees are authorized and directed to perform all acts necessary or desirable to give effect to this resolution.

Section 6. Whereas, it is necessary for the preservation of the peace, health and safety of the City of Tucson that this resolution become immediately effective, an emergency is hereby declared to exist, and this resolution shall be effective immediately upon its passage and adoption.
